New Judicial Principle "The dispute in the value of the late subscription of the Membership in sports clubs does not consider the delayed payment of the subscription fee as a reason to drop membership."

As an important judicial principle, Zaki Law Office (Legal & Banking Advisors) obtained the ruling of the Supreme Administrative Court issued on 4/11/2019 which rejects the appeal No. 93688 of the year 62 (Judiciary) and thus upholding the judgment issued by the Administrative Judicial Court (Second Circuit) headed by Mr. Counselor / Ahmed Mohamed El-Shazly - Vice-President of the State Council and President of the Court - in the lawsuit. No. 39263 for the year 61 (Judiciary) of the "dispute in the value of the late subscription is not considered a case of late payment of the subscription fee within the period specified in the Minister of Youth Resolution No. 836 of 2002 as approved by the basic system of the sports clubs" and therefore the dispute in the value of the due late subscription even if exceeded three years is not a reason for issuing the decision to drop membership.Where one of the prestigious sports clubs issued a decision to drop the membership of one of the clients of Zaki Law Office, saying that the client was late in paying the club's subscription fee for more than five years and the club had previously notified him of the due payment of LE 23898 for those years, the client objected on the value of this subscription and fines, and he sent a warning to the club offering to pay LE 5270 as a subscription fee and for paying the due fines based on article No.54 of the financial regulations of sports clubs. The club refused to receive this sum and considered the client in case of delay in paying the subscription fee for 3 consecutive years and dropped his membership. As a result, Zaki Law Office on behalf of the client filled a lawsuit No.39263 for the year 61 (Judiciary) requesting the cancellation of the management decision (Minister of Youth and Sports, Chairman of the National Sports Council) in front of the chairman of the prestigious club challenging the ministerial decree of not cancelling the decision of dropping the membership of the plaintiff, where the administrative court (second circuit)  rendered a judgment (under the chairmanship of  Mr. Counselor / Ahmed Mohamed El-Shazly - Vice-President of the State Council and President of the Court) to cancel the negative ministerial decree of non-cancelling the decision of dropping the membership, so the prestigious club appellant against such administrative justice where the supreme administrative court rejected such appeal, accordingly the administrative court is now a final one and non-challengeable.Such principle is considered a new edition from Zaki Law Office to the legal field.
